Cash-Out Refinance to Repay a Family Loan: What Lenders Need to See

Family helped you when you needed it. Now you want to pay them back. Here is how to turn your home equity into a clean, documented payoff.

When family lends you money, it comes with love and a quiet weight. You want to pay it back, and not just for the money. You want the relationship to feel clean again.

Your home may be the answer. If you have equity, a cash-out refinance can turn it into the cash to repay the loan. But lenders have rules about where the money goes, what is on paper, and who qualifies, and families often do not realize that until the file is in trouble.

Here is how it works, what to gather, and how much you might be able to take out.

Quick answer: Yes, you can often use a cash-out refinance to repay a family loan. Lenders typically allow cash-out proceeds to be used for any purpose, but they will ask for the loan paperwork and may need proof of how the family money was received and used. On a primary residence, conventional cash-out refinances commonly allow up to about 80 percent loan-to-value. You must qualify with your income and credit, and in Florida your spouse generally must sign the mortgage even if only one spouse’s income is used.

How Lenders Look at a Family Loan

For a cash-out refinance, the lender cares about three things: how much equity you have, whether you can afford the new payment, and whether the paperwork is clear. A family loan raises that third point more than most borrowers expect.

  • Where the money came from. If the family loan went into the home or paid off something tied to the home, it can matter for how the refinance is classified.
  • Whether it is documented. A signed note or a simple written agreement showing the amount and terms helps. A paper trail of the transfers helps more.
  • Where the money goes. Cash-out is generally yours to use, but a clear payoff to a family member is easier when the amount matches the documents.

If there is no paper trail, do not panic. Write down the history now while everyone remembers it, and tell your broker early so we can plan the file around it.

How Much Can You Take Out?

The size of your cash-out depends on your home value, your current balance and the maximum loan-to-value your program allows. A conventional cash-out on a primary home often tops out around 80 percent. Other programs, including non-QM options for borrowers who do not fit the standard box, have their own limits.

Qualifying When One Spouse Carries the Income

Many couples qualify on one income. That is fine, as long as the borrowing spouse’s income and credit support the new payment. In Florida, a non-borrowing spouse usually still signs the mortgage, because the home is the family’s homestead. Being on the mortgage as a signer is different from being on the note as a borrower, and I explain the difference to every couple before closing.

If the income is self-employed, bank statement programs can often calculate it from deposits. If credit is a concern, tell me early. Credit card balances can quietly lower your qualifying power, so timing payments before the credit pull can help.

Repaying a Family Loan With a Cash-Out Refinance: Common Questions

Can I use a cash-out refinance to pay back a family member?

Often yes. Cash-out proceeds can generally be used for any purpose, but lenders may ask for documentation of the family loan and how it was received.

How much equity do I need for a cash-out refinance?

On a primary residence, many conventional programs allow a loan up to about 80 percent of the home’s value. Other programs have different limits.

Does my family need to sign anything?

A written payoff statement from the family member is very helpful. A signed note or agreement from the time of the loan is even better.

Can I qualify with only my spouse’s income?

Yes, if that income and credit support the new loan. In Florida a non-borrowing spouse typically still signs the mortgage on a homestead.

What if I cannot qualify for a conventional cash-out?

Non-QM programs may offer options based on bank statements or other documentation, though they typically cost more. Compare the total cost before deciding.
